Position Title: Consultant

I: Essential Job Functions:

  • Conduct civil engineering reviews and investigations of construction claims centered around delays, disruptions, and cost increase in connection with litigation and settlement of commercial disputes;
  • Preparation of statement of claim with documents proof based on civil engineering analysis;
    • Research project record and case pleadings to verify and forensically determine the relevant evidence and fact patterns for the various claims and points of contention;
    • Operate and analyze native project contemporaneous schedules;
    • Interview witnesses to determine relevant facts and review evidence;
    • Review technical specifications, plans, engineering, etc. for determinations of merit and feasibility of Civil Engineering Project plans, schedule and changes;
    • Review technical civil engineering reports and opinions for relevance and inclusion in evidence;
    • Review legal opinions for conformance with expert opinions and fact patterns;
  • Examine and test veracity of alleged events occurring during civil engineering construction projects;
    • Creating databases and chronologies of key events and data to be used for verification of claims and analysis;
    • Analyzing project manpower, cost, budgets, degree of change, etc. data to test if claimed impacts resulted in lost hours and/or money;
    • Review project correspondence, meeting minutes, contemporaneous reports to test and document claims, notice, and events;
    • Write civil engineering reports using civil engineering expertise and analysis;
    • Research into civil engineering industry practices and studies for delay analysis, quantum analysis and productivity analysis;
    • Performance of civil engineering industry accepted and recommended practices for delay analysis, quantum analysis and productivity analysis;
    • Assemble exhibits, data support and organize to support and validate civil engineering analyses;
    • Author responses to other expert reports and provide critique of opposing expert analyses, methodologies and corrections.
  • Develop graphics to effectively present data using standard civil engineering industry technology, including Primavera, Revit, AutoCAD;
    • Compilation of complex schedule and cost data into manageable databases used to create graphics for reports and trial presentations;
    • Use of technical programs to create summary and detail graphic outputs;
  • Compile, analyze, and graph data in connection with civil engineering construction timelines and project cost control;
    • Assemble databases from client documents, discovery databases, and online discovery programs;
    • Transpose data from text, image and other documents into database programs;
    • Convert exports of cost and schedule data into manageable databases;
    • Use technical programs to display and organize data into useable formats and databases;
  • Perform forensic schedule analysis of civil engineering projects;
    • Open, operate and prepare schedules for use in civil engineering industry accepted schedule analyses;
    • Insert delay events into technical programs to model events in construction projects;
    • Validate schedule data using contractor budgets, estimates, bids, tenders, daily reports, pay applications, weekly/monthly reporting and project financial reports;
    • Perform AACE or SCL compliant schedule analyses for use in assessing the impact of delay events on a Project;
    • Accumulate results of impact analyses and perform concurrency and/or pacing analyses of other delays and events;
  • Assist with preparation of civil engineering related evidence in connection with arbitration or trial proceedings by assisting attorneys with:
    • Reviewing and ensuring accuracy of technical civil engineering evidence included in opening statements and closing statements/briefs;
    • Preparation of direct testimony of civil engineering fact and expert witnesses;
    • Preparation of cross-examination of civil engineering fact and expert witnesses;
    • Preparation of civil engineering evidence for appeals, etc.

 

II: Educational and Experience Requirements:

  • Bachelor’s Degree in Civil Engineering
  • 2 years of experience as a Civil Engineer or Site Engineer

 

III: Skills Required:

  • Experience performing quantity takeoffs, calculating costs and timelines, job site monitoring, cost control, compliance with safety regulations, and reading and interpreting construction drawings;
  • Primavera P6, Revit, AutoCAD.
